Professional Construction Services: These terms govern your use of Texas Rock Solid Building Services' construction and specialized building services. By engaging our services, you agree to these terms and conditions.
1. Services Overview
Texas Rock Solid Building Services, LLC ("Company," "we," "us") provides specialized construction services including:
- Sound proofing systems and acoustic solutions
- GypCrete and lightweight concrete applications
- Waterproofing and moisture protection systems
- Masonry and stucco work
- Nichiha wall panel installation
- EIFS (Exterior Insulation and Finish Systems)
- Related construction and building services
2. Service Agreements
Contract Formation
A binding contract is formed when:
- We provide a written estimate or proposal
- You accept our proposal in writing or through signed agreement
- Required deposits or payments are received
- Work commencement is mutually agreed upon
Estimates and Proposals
- All estimates are valid for 30 days unless otherwise specified
- Estimates are based on site conditions at time of inspection
- Final pricing may vary if conditions differ from initial assessment
- Change orders require written approval and may affect timeline and cost
3. Payment Terms
Payment Schedule
- Deposit: Typically 25-50% required to begin work
- Progress Payments: Due according to project milestones
- Final Payment: Due upon substantial completion and customer approval
- Payment Terms: Net 15 days unless otherwise agreed
Late Payments
- Late fees of 1.5% per month may apply to overdue balances
- Work may be suspended for accounts more than 30 days past due
- Customer responsible for collection costs and attorney fees
4. Project Execution
Timeline and Scheduling
- Project timelines are estimates based on normal conditions
- Delays due to weather, permits, or unforeseen conditions may extend completion
- Customer delays in decisions or access may affect project timeline
- We will communicate any significant schedule changes promptly
Site Access and Preparation
- Customer must provide safe, unobstructed access to work areas
- Customer responsible for moving personal property and protecting belongings
- Utilities (power, water) must be available at job site
- Required permits must be obtained before work begins
5. Quality and Warranties
Workmanship Warranty
- We warrant our workmanship for one (1) year from completion
- Material warranties are provided by manufacturers
- Warranty covers defects in workmanship under normal use
- Warranty does not cover damage from abuse, neglect, or normal wear
Standards and Compliance
- All work performed to industry standards and local building codes
- Required inspections will be scheduled and completed
- We maintain appropriate licenses, bonds, and insurance
- Safety protocols follow OSHA and industry best practices
6. Liability and Insurance
Full Insurance Coverage: Texas Rock Solid Building Services maintains comprehensive general liability insurance, workers' compensation, and bonding to protect our customers and employees.
Limitation of Liability
- Our liability is limited to the contract value of services provided
- We are not liable for consequential or indirect damages
- Customer must inspect work and report defects within reasonable time
- Insurance claims should be filed promptly for covered incidents
Customer Responsibilities
- Provide accurate information about property conditions
- Disclose known hazards (asbestos, lead paint, etc.)
- Maintain adequate property insurance during construction
- Follow safety guidelines when on active job sites
7. Changes and Modifications
Change Orders
- All changes to original scope must be documented in writing
- Additional work will be charged at prevailing rates
- Change orders may affect project timeline
- Customer approval required before additional work begins
Unforeseen Conditions
- Hidden conditions may require additional work
- Structural issues discovered during work will be addressed
- Code compliance updates may necessitate additional work
- Customer will be notified of additional costs before proceeding
8. Cancellation and Termination
Customer Cancellation
- Customer may cancel with written notice
- Payment due for all work completed and materials ordered
- Cancellation fees may apply for custom materials
- Equipment and materials will be removed at customer expense
Company Termination
We reserve the right to terminate services for:
- Non-payment or breach of contract terms
- Unsafe site conditions
- Interference with work performance
- Failure to obtain required permits
Important: Termination does not relieve customer of payment obligations for work completed and materials supplied.
9. Dispute Resolution
Resolution Process
- Disputes should first be addressed directly with project management
- Written complaints will receive prompt investigation
- Mediation preferred before legal action
- Texas law governs all agreements and disputes
Legal Jurisdiction
- All disputes subject to Texas state law
- Venue for legal proceedings: Travis County, Texas
- Prevailing party entitled to attorney fees and costs
